Tax on sale by an NRI
When an NRI sells, the buyer must deduct TDS at non-resident rates and needs a TAN. Without a lower deduction certificate, buyers usually deduct on the full sale value, so apply for a certificate based on your actual capital gain before the deal. Your CA should compute the gain and file your return.
Buying as an NRI or OCI
NRIs and OCI cardholders can buy residential and commercial property in India, but not agricultural land, plantation property or farmhouses (these can only come by inheritance). Repatriation of sale proceeds of residential property is allowed for up to two properties, subject to FEMA conditions.
Payment must come through banking channels from NRE/NRO/FCNR accounts or inward remittance.
Taking the money abroad
Rent from Indian property should be credited to your NRO account. Money can be moved from NRO to your NRE or foreign account within the FEMA limit of USD 1 million per financial year, after taxes, using Form 15CA (and Form 15CB from a chartered accountant where required).

Frequently asked questions
Can I sell my property in India without travelling?
Yes, through a registered power of attorney given to a trusted person who signs at the Sub-Registrar. Many owners still prefer to be present for registry.
Can an NRI buy agricultural land in India?
No. NRIs and OCIs cannot buy agricultural land, plantation property or farmhouses; they can inherit them.
Do you guarantee a buyer or price?
No. We market and coordinate; price and timing depend on the market and your decisions.
